Displaced people from Ukraine may have their residence permit for Norway extended by a further year

The Ministry of Justice and Public Security today made an amendment to Norway’s Immigration Regulations allowing Ukrainians, who have had temporary collective protection for three years, to be granted continued residence in Norway for a further year.
Міністерство юстиції та з надзвичайних ситуацій сьогодні внесло зміни в імміграційні правила, згідно з якими українці, які мали тимчасовий колективний захист протягом трьох років, можуть отримати продовження дозволу на проживання ще на 1 рік.
Уряд продовжує дію схеми тимчасового колективного захисту для переселенців з України, і люди, які мали такий дозвіл протягом трьох років, тепер можуть продовжити його на четвертий рік на тих же умовах, що й попередні продовження. 11 березня 2022 року уряд запровадив схему тимчасового колективного захисту для переселенців з України. Схема перeдбачає, що ті, кого вона охоплює, отримують дозвіл на проживання на один рік за спрощеною процедурою та без індивідуальної оцінки потреби в захисті. Сьогоднішні зміни в правилах дають людям, які все ще належать до групи осіб, які підпадають схему тимчасового колективного захисту, право на продовжений дозвіл на четвертий рік. Дозвіл буде продовжено після закінчення сроку його дії Норвезьким управлінням імміграції (UDI). Особи, на яких це поширюється, не зобовязані подавати заяву про продовження дозволую. UDI та поліція також забезпечуватимуть відновлення прострочених посвідок на проживання.
Причиною рішення уряду про продовження є, серед іншого, те, що схему тимчасового захисту було продовжено ЄС до березня 2026 року, а подальший розвиток подій в Україні все ще залишається невизначеним. Систему тимчасового колективного захисту було обмежено у вересні 2024 року, щоб вона більше не поширювалася на нових заявників із областей, які імміграційна влада вважає безпечними з точки зору імміграційного законодавства. Зараз Управління імміграції вважає безпечними 14 областей України. Уряд pегулярно оцінюватиме подальші зміни схеми тимчасового колективного захисту.
The Government is continuing the temporary collective protection scheme for displaced persons from Ukraine; thus, people who have had such protection for three years can now be granted an extension of their permit for a fourth year on the same conditions as previous extensions.
On 11 March 2022, the Government introduced a temporary collective protection scheme for displaced people from Ukraine. Those who are covered by the scheme are granted a residence permit for one year following a simplified procedure without an individual assessment of their need for protection. Today’s amendment to the regulations gives those who still belong to the category of people receiving temporary collective protection, the right to extend their permit for a fourth year. The Norwegian Directorate of Immigration (UDI) will renew the permits upon expiration; therefore, it is not necessary for those covered by the scheme to apply for the extension. UDI and the police will also ensure that expired residence cards are renewed.
The Government has decided to implement the extension because, inter alia, the EU Temporary Protection Directive has been extended up until March 2026, and future developments in Ukraine are still uncertain. The temporary collective protection scheme was tightened in September 2024, so it no longer applies to new applicants from areas which the immigration office considers safe in terms of immigration law. The Norwegian Directorate of Immigration now considers 14 counties in Ukraine safe. The Government will consider further changes to the temporary protection scheme on an ongoing basis.
