Regulations relating to nonylphenol and octylphenol and their ethoxylates

Laid down by the Ministry of the Environment on 8 October 2001 pursuant to section 4 of the Act of 11 June 1976 No. 79 relating to the control of products and consumer services (the Product Control Act), cf. Royal Decree of 7 September 1990 No. 730. Cf. the EEA Agreement, Annex II, Chapter XIX (Council Directive 98/34/EC with subsequent amendments).

§ 1 Purpose

The purpose of these regulations is to prevent environmental damage caused by the release of nonylphenol and octylphenol and their ethoxylates to the environment.

§ 2 Scope

These regulations lay down provisions on the manufacture, import, export, sale and use of nonylphenol and octylphenol and their ethoxylates and preparations containing these substances. The regulations do not apply where the use of these substances or preparations is governed by other legislation.

The regulations do not apply to solid processed articles.

§ 3 Prohibition

It is prohibited to import, export, sell or use nonylphenol and octylphenol and their ethoxylates and preparations containing these substances.

This prohibition does not apply to nonylphenol and octylphenol and their ethoxylates in or for use in paints and varnishes and in lubricating oils.

The prohibition does not apply to nonylphenol and octylphenol and their ethoxylates and preparations containing these substances for the purposes of research and analysis.

§ 4 Exemptions

If special reasons so indicate, the Norwegian Pollution Control Authority or the instance so authorized by the Ministry of the Environment may grant exemptions from these regulations.

§ 5 Control

The Norwegian Pollution Control Authority or the instance so authorized by the Ministry of the Environment will be responsible for ensuring compliance with these regulations.

§ 6 Coercive fines

In order to ensure compliance with the provisions of these regulations or decisions made pursuant thereto, the Norwegian Pollution Control Authority or the instance so authorized by the Ministry of the Environment may impose coercive fines in according section 13 of the Product Control Act.

§ 7 Appeals

Decisions made pursuant to these regulations may be appealed to the Ministry of the Environment or to the instance so authorized by the Ministry of the Environment.

§ 8 Penal measures

Any contravention of these regulations or of decisions made pursuant thereto is subject to a penalty in accordance with section 12 of the Product Control Act unless more severe penal provisions apply.

§ 9 Entry into force and transitional provisions

These regulations enter into force on 1 January 2002.

Substances and preparations that are manufactured in Norway or imported to Norway before the provisions of the regulations enter into force may nevertheless be sold, exported and used for a period of six months from the date of their entry into force.
